Billing
The amendments add certainty that
contractors will be paid in a timely
manner. Under the Prompt Payment and
Construction Lien Act, general contractors
generally must issue a proper invoice
(as defined in Bill 37) to the project
owner every 31 calendar days.
The general contractor must receive
payment of any undisputed amount
from the project owner within 28 calendar
days of issuing their invoice.
Consequently, within seven calendar
days of receiving payment, the general
contractor’s subcontractors must each
receive payment. This seven-day payment
structure continues until all contractors
are paid.
Under the new legislation, parties
cannot opt out of this payment
